5 - Order taking

Any purchase order signed with the validation click constitutes an irrevocable commitment from the customer which can only be called into question in the cases limited to this contract in the articles “Right of withdrawal” and “Execution of the order”.

 

6 - Order confirmation

The conclusion of the contract will only take place at the time of confirmation of the order by LOFT ATTITUDE.

The customer will receive by email an acknowledgment of receipt confirming the order with all the elements constituting the contract (products ordered, prices, delivery times, shipping costs, etc.)

LOFT ATTITUDE reserves the right not to confirm an order for any reason whatsoever, in particular due to either a problem with the supply of products, or a problem concerning the order received.

 

7 - Duration of the offer

8 - Price - Invoice

The prices are printed in euros.

The price of shipping costs indicated on the site only concerns deliveries to individuals. Deliveries intended for professionals benefit from specific prices adapted to orders.

9 - Payment

Payment of the entire price is due upon ordering.

The customer undertakes to pay the price stipulated for the product ordered on the Site (price of the products and transport) as well as to pay or have paid, where applicable, directly to the forwarder or carrier, the shipping rights. customs, VAT or other taxes due upon importation of products into the country of delivery.

The customer pays his order:

The customer guarantees LOFT ATTITUDE that he has the necessary authorizations to use the card payment method when taking the order. Any attempted fraud will be prosecuted in court.

10 - Failure to pay - Reservation of title

The products ordered remain the property of LOFT ATTITUDE until final and full payment of their price in accordance with the terms of law no. 80 335 of May 12, 1980. LOFT ATTITUDE reserves the right to claim the products ordered in the event of default. payment.

Invoices will be payable in Euros upon receipt and at the latest within 90 days from their date of issue.
Any late payment will result in late payment penalties at a rate equal to 10% and a minimum fixed compensation of 40 (forty) euros for recovery costs, due automatically, without a reminder being necessary following Article D. 441-5 of the Commercial Code.

In this case and upon first request from LOFT ATTITUDE, the customer undertakes to return any unpaid product, all costs at his expense.

 

11 - Transfer of risks

The transfer of risks to the customer occurs upon delivery of the products by LOFT ATTITUDE to the carrier. The products travel at the customer’s own risk. The same applies in the event of sending or returning products free of charge.

During the withdrawal period mentioned in article 17 below, the customer is responsible for the item as guardian. In the event of deterioration or destruction of the product during the customer's custody, the latter will suffer all the consequences.

 

12 - Execution of the command

The order will be executed within the deadlines specified on the Site and upon confirmation of the order by LOFT ATTITUDE and in any event no later than 30 days following confirmation of the order subject to the availability of the product ordered and unless specifically agreed between the parties.

In the event of a stock shortage or unavailability of the ordered product, LOFT ATTITUDE undertakes to inform the customer as soon as possible and to specify an availability time frame.

The customer will confirm by e-mail his choice either to wait for the product to be available or to be reimbursed.

 

13 - Delivery

The geographic delivery area corresponds to the geographic coverage area of ​​the offer.

The products are delivered to the address indicated by the customer on the order form.

Delivery is deemed to have been made upon handing over of the product to the carrier.

The delivery slip provided by the carrier, dated and signed by the customer upon delivery of the product will constitute proof of transport and delivery.

In order to keep your delivery costs as low as possible, we strive to ship items as quickly as possible, while limiting the number of shipments. When you place an order for a non-stock product, one copy is automatically reserved for you. You will receive it upon receipt of it in our warehouses. We will keep you informed of the delivery time by email.

Large packages are delivered under normal delivery conditions. Furniture is delivered to your doorstep by carrier. Under no circumstances are our carriers authorized to climb floors. No forklift rental will be covered by LOFT ATTITUDE.

 

14 - Force majeure

Expressly considered as cases of force majeure, in addition to those usually retained by the jurisprudence of French courts and tribunals,

- total or partial strikes, internal or external to the company, blocking of means of transport or supply for any reason whatsoever, government or legal restrictions, computer breakdowns, blocking of telecommunications including networks and in particular Internet.

The occurrence of a case of force majeure will initially automatically suspend execution of the order.

If beyond a period of three (3) months, the parties note the persistence of the case of force majeure, the order will be automatically canceled, unless otherwise agreed by both parties.

 

15 - Withdrawal of products in the event of the customer's absence

If the recipient is absent during delivery, the carrier will leave a delivery notice to the delivery address indicated by the customer. The products must be collected from the address and according to the methods indicated by the carrier.

In the event of non-collection within the time limit set by the carrier, the products will be returned to LOFT ATTITUDE which reserves the right to reimburse the price, the shipping costs remaining the responsibility of the customer.

 

16 - Complaints

Complaints for non-conformity of the product(s) delivered with the order must be made in writing with supporting photo directly to our mailbox: info@loftattitude.com and this immediately upon receipt. The customer must keep the packaging and the delivery slip.

Any complaints must be sent within 24 hours of delivery of the goods in the original packaging. After this period, LOFT ATTITUDE is no longer required to accept the complaint.

 

17 - Right of withdrawal

The LOFT ATTITUDE customer has, within (14) fourteen working days from delivery of his order, the right to return, at his own expense, for exchange or reimbursement, products which do not suit him in accordance with in article L 121–16 of the Consumer Code. After 14 days, the right of withdrawal no longer comes into force.

If this period expires on a Saturday, Sunday or public or non-working holiday, it is extended until the first following working day.

The returned product must be in its original condition and packaging. It must not have been used, nor have suffered any deterioration, however minimal, and be in a perfectly clean state.

This right of withdrawal is exercised without penalties, with the exception of return costs.

Any order canceled after shipment (order status "in progress") will necessarily result in return transport costs payable by the customer, even if the order has not yet been delivered

Within a maximum period of 15 days from receipt of the product, the customer will be reimbursed for the sums paid. The refund will be made by the same means of payment as that used by the buyer to pay for their purchases. The consumer can, however, agree to another reimbursement such as by bank transfer or PayPal.

Returned items travel at the customers’ own risk.

The items must be returned to us in the condition in which you received them with all the elements (accessories, packaging, instructions, etc.).

If the product is not perfectly packaged, the return may be refused.

Article L121-20 of the Consumer Code provides for a period of 7 working days to withdraw. 18 - Guarantee

In any case, the products sold benefit from the legal guarantee against hidden defects provided for by articles 1641 et seq. of the Civil Code.

Finally, some products benefit from an extended warranty. In these cases, the terms and duration of the warranty are specified in the warranty card delivered with the product. This does not cover damage, breakages or malfunctions due to non-compliance with the precautions for use.

For the implementation of the guarantee, the customer returns the product to LOFT ATTITUDE at his own expense, attaching the original invoice.

The product will be exchanged for an identical product and sent to the customer at LOFT ATTITUDE's expense, except in the event of stock shortage or disappearance of the product from the range offered by LOFT ATTITUDE. In this last hypothesis, LOFT ATTITUDE will reimburse the price of the product to the customer.

 

19 - Personal information

The personal information requested from the customer is essential for the processing and delivery of orders, the preparation of invoices and possible warranty contracts. For these purposes, this information may be communicated to LOFT ATTITUDE's contractual partners.

20 - Electronic signature

Computerized records, kept in the computer systems of LOFT ATTITUDE or its subcontractors, under reasonable security conditions will be considered as proof of communication, orders and payments made between the parties.

The archiving of purchase orders and invoices is carried out on a reliable and durable medium that can be produced as proof.

22 - Intellectual property

LOFT ATTITUDE holds the intellectual property rights on the site and the right to distribute the elements appearing in the catalog of the electronic store and in particular the photographs for which it has obtained the necessary authorizations from the persons concerned.

24 - Non-waiver

The fact that LOFT ATTITUDE does not take advantage of a breach by the customer of any of its obligations cannot be interpreted as a waiver of the obligation concerned and to take advantage of this breach subsequently.

25 - Nullity

If one or more stipulations of these general conditions is held to be invalid or declared such in application of a law, a regulation or following a final decision of a competent court, the other stipulations will retain all their force. and their scope.

 

26 - Dispute

IN THE EVENT OF A DISPUTE AND IN THE FAILURE OF AN AMICABLE AGREEMENT BETWEEN THE PARTIES, EXPRESS JURISDICTION IS ASSIGNED TO THE COURTS OF THE REGION OF THE HEAD OFFICE OF LOFT ATTITUDE, NOTWITHSTANDING CALL FOR GUARANTEE OR PLURALITY OF DEFENDANTS, EVEN FOR EMERGENCY PROCEDURES OR PROSERVATORY PROCEDURES IN REFERENCE OR BY REQUEST.
